Yes and well done now all you have to do is find enough CONCRETE evidence when it does go to a tribunal, as for me I simply save this thread in a word document.

Holy, yes I guess even for a Boksburger you have more brains than some.

As for the stupid comments about getting bullied by the wholesalers, well buy a new car and slap on a free flow exhaust and see what they have to say.

Blah, blah, blah the consumer this and the consumer that, take it up with the bike manugfacturer if you are unhappy, as that is where it originates from.

But then again, all bike shops and all wholesalers are stupid, oh and let me not forget, most bike shop mechanics allegedly don't know how to hold their spanners.

it is all very well reading warrantee claims and deciding for yourself that you wont void the warrantee if you file the stops BUT as summit and i had a discussion today about this very thing you cant put a seal on a shock backwards,



So why are you guys trying to take shortcuts with bike designs and warantees that have clearly been stated to be against modifications of ANY sorts



sorry johan and all your followers but just like filing a Zipp rim because you are not happy about spoke arrival angel and then badmouthing a brand because you feel the need to make a joke it is wrong and i will tell you to your face that you are not only playing with your own business and well being here you are messing it up for the rest of us that have to fix mistakes that you take it upon yourself to condone!!!

This issue has nothing to do with an implied warranty. This is an express warranty contained in the warranty documents you get with the purchase of your new bike/frame. This document will quite clearly set out the conditions upon which the purchaser can exercise HIS RIGHTS under the warranty agreement. The exercise of these right will correspondingly be restricted by the owner's exercise of HIS OBLIGATIONS under the agreement. These same obligations and rights exist on the side of the manufacturer.


So where a manufacturer specifies the warranty applies only to unmodified equipment, before you want to exercise your claim rights under that warranty, make very sure you fulfil your obligations and refrain from modifying or altering the equipment. This would be prudent, never mind fair. Otherwise don't be surprised if the manufacturer questions whether or not you have kept your side of the bargain before you complain about him not keeping his part.

 

I'd also suggest to anyone contemplating this alteration that they carefully read the terms of their warranty agreement. This, long before taking at face value supposed legal advice framed in terms such as

"The first time a frame manufacturer throws the guarantee at you, you hit him with a copy of the Act and/or moer him, whichever suits your size."

or better yet

"..... we gooi them a toffee and make the distributor accountable. "

 

I never came across terms like this when I was in the legal trade.Smile

If I sold someone a product which they then alter, after which it breaks, I would not replace it! Seriously, there is no way that an altered product should still be replaced under warranty.

You okes are forgetting one piece of vital information.
A large fraction of readers bikes on this forum is most probably outside warranty in any case!!

So, this entire discussion is meaningless for a large number of readers.

I for one find the infomation informative - the descisions till lies with me whether I'll follow it or not. A mere warranty warning should suffice.

 

Alos, don't get personal, Summit - put your gloves back on!! It's cold in the mornings and you will graze the skin off your fingers should you be fortunate enough to meet a tree or something similar on your route!!Wink

 

If some of you have issues with JB and his comments...take it to another forum!! This is suppose to be Tech discussions.

 

And just by the way - Johan is about the only person that takes time to research and draw up INFORMATIVE material that generally enrich this forum..

 

I have not yet seen any quality contibutions from either Summit or Turtlek that match the effort put in from JB.

It is very easy to criticise...rather show us some good quality informative posts!! and that does not mean that I just take all JB suggestions and implement them....good common sense still prevail...BUT I've yet to see someone else making such an effort to part with knowledge.

cassie, just why do you have such an issue when his advice is challenged? in this case, his assertion about warranties appears to be flawed. surely, pointing this out has some value too.

ag, summit, leave cassie. he's not worth it. he got personal with me on another thread too. funny how he criticises people for not adding value or imparting info, when he does precious little of it himself.

with a frame like that u myt aswell drill the cables in the top tube....it wont break...i got one of them....
make it look like the road bikes with the cables in the tubes....

HR, agreed...it does have value...but that is where it should stop.

I just think, this being a Tech forum....the discussions should be focussed on Tech aspects...

Warranty issues is a very grey area in most, if not all cases.

 

Tampering with a frame - i'll decide if i'm willing to void the warranty or not....a mere warning is good enough.

 

Summit, no beef with you...I just sense a serious negative vibe everytime you comment on anything JB has to say...why, I do not know and frankly, not my bussiness..

If any of Johan's advice is WRONG...please point it out to the rest of us...and correct him.

If you want to flame him for personal reasons...maybe we should start a Forum where we can vent our anger....Hmmm, sounds familiar - maybe I've seen something like this here somewhere?
