Lotus has provided sensible advice.

Speak to a compliance manager or a SHEQ (Safety, health, environment, quality) manager if you have one at your place of work - print and take the pictures along with you as it will surely evoke some reaction from them. Speak to your immediate manager as well, as they may have some pull with HR.


If you want to go the legal route, then the small claims court is your best bet - it is cheap (no lawyers involved from both sides). Present the pics of the job done and explain that instead of fixing the problem, the contractor merely diverted the water to the floor. Also point out that the repaired crack in the wall proves that the water had been leaking for a long time and the leak was never properly repaired. Bring up the adverts on radio, and the company will then need to answer to how that translates to your siuation. The company will then no doubt provide evidence of the wonderful work it did and the qualifications of the contractor, but that pic of yours is worth a thousand words. If you spent money fixing your fridge take those receipts along as well - I am sure you will be compensated for that. Your big issue, to me, is to prove how much the food in the fridge actually cost - but even if you come out with less money, nothing will go to a lawyer - it all comes directly to you.


Visit your local courthouse and ask to be directed to the small claims court - they have people to help with filling in the forms etc. It won't cost you a cent, other than time of work to present your case. good luck.

the unfortunate truth is that if you chose to take on your employer with the legal route you will probably end up loosing your job. They will find a way to shaft you, retrenchment, mutual breakdown of the relationship, etc, etc. You need to decide what its worth to you.....Been unemployed and homeless after winning R 2,500 and a moral victory just doesnt seem worth it.

You probably do have recourse, but as couple of posters have indicated, it will cost you more than you gain, both in terms of fees and also your relationship and future prospects with the company.

At this point the only possible approach left that is not destructive is to speak with your manager and get him on your side. He can in turn enlist the support of his management, and at that stage you may have the leverage to overcome the obstructive individuals.

I'm quite sure you've already contemplated the cost of your loss against the value of your job, and taking the "soft" approach will do your future with this company no harm. Thinking in terms of "legal recourse" is likely to become confrontational, and then it's a short road to a bad relationship.
